Army, COAS Absence Stalls Shiite 2BN Suite Against FG

Absence of the Nigerian army and Chief of Army Staff on Wednesday stalled a case of 2billion naira damages filed against the Nigerian Army, Chief of Army Staff, Anthony General of the Federation ( AGF) and the Anthony General of Kaduna State by leader of the Islamic Movement of Nigeria, Sheik Ibraheem El-Zakzaky and his wife, Zeenat Zakzaky.

Sheik El-Zakzaky, through his team of lawyers led by Maxwell Kyon Esq, had filed an application demanding ‎the sum of 2billion naira as general damages for violating their Fundamental Human Rights.

But two of the respondents, the Nigerian Army and Chief of Army Staff were absent and were not represented by any lawyer. Meanwhile, the led counsel for the AGF also requested for sufficient time to file in his response as the El-Zakzaky’s application did not get to him on time, the request was granted by the judge. 

The presiding judge, Justice Saleh Musa Shuaibu of a Federal High Court sitting in Kaduna, however, adjourned the case till ‎June 7th 2016, on the ground that the case is very sensitive and as such all parties in the matter should be giving fair hearing.

He ordered that the Nigerian Army and Chief of Army Staff be served another notice pending next hearing of the case in the said date.

‎IMN lawyers led by Barrister Festus Okoye, had accused the Nigerian government of incarcerating
‎El-Zakzaky since December and thereby denying him access to his doctor, family members and friends which violates the African Charter on Human and Peoples Rights.

Speaking to journalists on the matter, Maxwell Kyon Esq, said ‎he is satisfied with the decision of the judge in the spirit of justice.
