Army/Shi’ite Clash: IMN Vows Not to Participate in Judicial Panel

The Islamic Movement in Nigeria (IMN) said it will henceforth declined participation and have any further dealings with the judicial Commission of inquiry.

It also stated that it would consult and direct their lawyers on the next course of action in search of justice in this matter.

Meanwhile, the Commission of inquiry has adjourned their sitting to the 7th of March, 2016 for continuation of proceedings on the inquiry.

The adjournment was sequel to the inability of the counsel to the IMN to see the leader of the shi’ite group Shiekh Ibraheem El-Zakzaky and get briefings from him.

It would be recalled that the judicial panel since it started it’s sitting on the 22nd February, 2016 had adjourned it’s sitting three times on the same account.

‎The Commission had at its inaugural sitting on Monday 22nd February 2016 adjourned till (Wednesday) 24th February 2016 for continuation of proceedings following the absence of the counsel to the Movement at the panel who had written to the commission that it would only appear and present memorandum only after it gets access and briefings from its client and leader of the movement.
‎However, when the counsel to the Movement, Mr. Maxwel Kyon appeared before the Commission on the. 24th, he said, he was unable to get access to his client and requested for two weeks adjournment to enable him get access and briefing from his client.

But the Chairman of the Commission, Justice Muhammadu Lawal Garba adjourned the sitting till today 29th February, 2016‎.

Again, the sitting was adjourned till 7th March, 2016‎ as the counsel to IMN told the commission that all efforts made to see his client proved abortive and opted to withdraw from further representation.

It would also be recalled that various counsels’ appeared before the commission to represent the Nigerian Army, the Supreme Council for Shari’a in Nigeria, Jama’atu Nasril Islam, the Gyellesu /Sabon-Gari, Zaria communities and some interested groups from Sokoto. However, the IMN was not represented during the inaugural sitting.

The commission however advised them to explore other options of reaching to the leadership of the IMN, with a view to getting proper instruction. The commission further directed counsel to the commission to work in concert with the counsel to IMN, to access their client and obtain necessary instruction.

Before adjourning the proceedings of the commission, the Commissions Chairman reiterated the avowed intention of the commission to ensure that all parties will be fairly treated, in the discharge of the mandate given to the commission.

Meanwhile, the commission has so far received more than two hundred memoranda from various organizations, including security agencies, traditional/religious institutions and individuals. 

‎But the text of the press briefing by the IMN signed by Abdulhamid Bello said, the appearance at the commission will be predicated on “the unconditional release of the  movement Sheikh Ibraheem Zakzaky to lead the movement to the said commission of inquiry set up by the Kaduna State Government.

“The Judicial Commission of inquiry must be reconstituted. The Kaduna State Government that set up the Commission is an aggressor. Some of the members of the Commission represent some of the services that engaged in acts of genocide. Against the movement.

“Based on all these, we decline to participate and have any further dealings with the Judicial Commission of inquiry. We would consult with our lawyers on the next course of action in search of justice in this matter” the movement stated.
