A Customary Court sitting in Sabon/Tasha, Kaduna has adjourned until 14th December a case filed by one Hon. Ayuba kure of CC16B Kuje street, Gwari, Kakuri and his three sisters ( Deborah, Abigail and Grace) are accussing one of their younger brother, Mashall Kure of breaking into their father’s room and thereby carting away documents of their father’s properties.
Ayuba who was a candidate of Kaduna State House of Assembly in the just concluded 2015 elections under the platform of Labour Party in Makera Constituency prays the court to compel his brother to return all documents he allegedly stole from his father’s room imediately after his death.
The president of the court, John Ambo adjourned the case on the request of the counsel to the defendant, Barr. Yakubu Maikarfi that the court should give him time to look into the case and also to enable him speak with with parties since it is a family issue.
Barr. Yakubu said told the court that in cases like this, “it is shameful to present something of this nature before a court when it can be resolved amicably out of Court. ”
He said the accusations against his client is a mere allegation as his client who is the last born of their father had told him that his father willed his properties to him.
The President of the court had during the proceedings advised the two counsels to see a away of settling the case out of Court knowing that they are from the same parents and because the two lawyers are friends of the family.
Earlier in his testimony before the court, Hon. Kure had stressed that as the first born of their parents and the heir apparent of the family, he should be the one to be in possession of their father’s properties.
But his younger brother while speaking with newsmen said their father willed all his belongings to him in the present of elders of the family because his elder brother and sisters had abandoned their father in his old age.
According to him, his elder brother and sisters are only ganging up against because their father did not leave any of his properties in their possession.
Meanwhile, counsel to the plaintiffs Barr. Ben Asogwa said will be glad if his client and the defendant agree on an out of court settlement since they are siblings.
Although, the court was yet cross examine the defendant to hear his own side of the story before the adjournment.
Their father, Dauda Kure before his death was the District Head of Krumi Gwaza in Kachia Local Government Area of Kaduna State.
