Kaduna Businessman vs Nigerian Army, DG SSS: Court Adjourns for Ruling

A Federal High Court sitting in Kaduna, on Monday adjourned for ruling till April 2nd 2020, a human right infringement case brought against the Nigerian Army and the Director General State Security Services (SSS), by a Kaduna businessman, Alhaji Ibrahim Musa Gashash.
Counsel to Gashash, popularly known as Sardaunan Matasa, Umar Magaji, had filed an application against the Nigerian Army, the Chief of Army Staff (COAS), the General Officer Commanding (GOC) 1 Division and the Director General of the State Security Services for illegally and unlawfully arresting him.
About 20 of the 1 Division Nigerian Army, Kaduna on 1st January 2020 invaded the house of the business in Kakuri, without search warrant and whisked him away.
He was however released after Justice Zainab Abubakar, granted an application filed by his counsel, directing the Nigerian Army and the SSS to release him with immediate effect.
At the first hearing of the case on Tuesday, 11th February, the case was adjourned to enable the applicant file affidavit removing the 4th respondent (DG SSS), from the trial since they had already been served with the court summons, after counsel to the applicant had notified the court of the intention to remove the DG SSS from the case.
But at this Monday hearing, Counsel to the applicant rescinds their decision saying they have changed their minds to continue the case with the 4th respondent.
After hearing the submission of both counsels, the presiding Judge, Justice Zainab Abubakar, adjourned the case till April 2nd 2020 for ruling, decision both counsels accepted.
